1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of the LeadSense platform and related services ("Services"), operated by Botsense Tech Private Limited("Botsense", "we", "us", or "our"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Description of Services

LeadSense is a multi-product SaaS platform that may include, in whole or in part:

• WhatsApp Business messaging and automation
• CRM and lead-management tools
• AI-assisted calling
• AI-powered lead discovery and enrichment

Features available to you depend on the plan you select and any prepaid credits on your account. We may add, modify, or discontinue features over time.

3. Accounts and Eligibility

You must provide accurate registration information and are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. The Services are intended for business use by users who can form a legally binding contract.

4. Acceptable Use

You agree not to use the Services to:

• Send spam, unsolicited messages, or any communication that violates applicable law or the policies of WhatsApp/Meta or any telecom or messaging provider
• Send messages to recipients who have not consented to be contacted, or after they have opted out
• Transmit unlawful, fraudulent, deceptive, harassing, or infringing content
• Attempt to gain unauthorized access to, disrupt, or reverse engineer the Services
• Resell or expose the Services in a manner not permitted by your plan

You are solely responsible for the content of messages you send and for obtaining all necessary consents from your recipients.

5. Plans, Prepaid Credits & Payments

Certain features are offered on subscription plans; others operate on a prepaid credit / wallet model (for example, AI calling, AI lead discovery, and WhatsApp messaging recharges).

• Prepaid credits are added to your account balance when you recharge and are consumed as you use the corresponding features.
• Subscription plans are billed for the applicable billing period and renew unless cancelled before the next renewal date.
• Payments are processed by our third-party payment gateway (PayU). We do not store your full card or banking details.
• Applicable taxes (including GST) may be added to amounts payable.

Refunds and cancellations are governed by our Refund & Cancellation Policy.

6. Third-Party Dependencies & Availability

The Services rely on third-party platforms and providers, including Meta/WhatsApp and telecom and messaging partners. Delivery, throughput, pricing, and availability of messaging and calling are subject to those providers' systems, policies, and approvals, which are outside our control. We do not guarantee uninterrupted or error-free operation, message/call delivery, or specific delivery times, and we are not liable for outages, rejections, rate limits, account actions, or pricing changes imposed by third parties. We provide the Services on an "as is" and "as available" basis.

7. Limitation of Liability

To the maximum extent permitted by law, Botsense shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business, arising out of or related to your use of the Services. Our total aggregate liability for any claim relating to the Services shall not exceed the amount paid by you to us for the Services in the three (3) months preceding the event giving rise to the claim.

8. Suspension & Termination

We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, the acceptable-use rules, or applicable law, or if required by a third-party provider. You may stop using the Services and cancel renewals at any time. Treatment of balances and fees on termination is governed by the Refund & Cancellation Policy.

9. Intellectual Property

The Services, including all software, content, and trademarks (other than your own data and content), are owned by Botsense Tech Private Limited or its licensors. You retain ownership of the data and content you provide, and you grant us a limited licence to process it solely to provide the Services.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts at Indore, Madhya Pradesh shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Services.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
